Terms and customer groups
SDB Vitrinebouw B.V. supplies business customers, resellers and consumers. The general terms and conditions that apply depend on the capacity of the customer and the nature of the agreement.
The applicable general terms and conditions will be made available to the customer before or at the time the agreement is concluded.
Consumers
A consumer is a natural person acting for purposes outside their trade, business or profession.
The Metaalunie Consumer Terms and Conditions 2022 apply to agreements concluded directly between SDB Vitrinebouw B.V. and consumers.
For distance purchases, the statutory rules governing distance contracts and the information concerning the right of withdrawal also apply, unless a statutory exception applies.
The Metaalunie Consumer Terms and Conditions 2022 can be viewed, saved and printed via the hyperlink at the bottom of this page. These terms and conditions are specifically intended for agreements between a Metaalunie member and a consumer.
Business customers and resellers
The Metaalunie Terms and Conditions 2025 apply to all quotations, orders and agreements with business customers and resellers, unless expressly agreed otherwise in writing before or at the time the agreement is concluded.
This applies to:
- orders placed via the webshop;
- orders placed by email;
- orders based on a quotation;
- telephone orders confirmed in writing;
- separate order confirmations.
The Metaalunie Terms and Conditions 2025 will be provided as an attachment before or at the time the agreement is concluded.
Provisions on this website that are specifically intended for consumers, including information about the statutory right of withdrawal and statutory consumer rights, do not apply to business customers and resellers.
Additional Terms and Conditions of SDB Vitrinebouw
In addition to the applicable general terms and conditions, the Additional Terms and Conditions of SDB Vitrinebouw 2026 apply, provided they have been made available to the customer before or at the time the agreement is concluded.
These additional terms and conditions contain provisions relating to, among other things:
- transport;
- delivery;
- inspection upon receipt;
- accessibility of the delivery location;
- product specifications;
- possible differences in colour, dimensions and details.
In the event of a conflict, the following order of priority applies:
- the individual written agreement or order confirmation;
- the applicable Metaalunie Terms and Conditions or Consumer Terms and Conditions;
- the Additional Terms and Conditions of SDB Vitrinebouw 2026.
Warranty
Warranty for consumers
Consumers are entitled to their statutory warranty rights and the rights set out in Article 24 of the Metaalunie Consumer Terms and Conditions 2022.
SDB Vitrinebouw B.V. warrants that the delivered product complies with the agreement and possesses the characteristics that the consumer may reasonably expect.
If a defect becomes apparent within one year after delivery, the Metaalunie Consumer Terms and Conditions provide that the product is presumed not to have complied with the agreement at the time of delivery, unless SDB Vitrinebouw B.V. proves otherwise. SDB Vitrinebouw B.V. may also remain liable under the law for defects that become apparent after this period.
No claim may be made insofar as the defect was caused by:
- normal wear and tear;
- improper, incorrect or unintended use;
- insufficient or incorrect maintenance;
- dropping, impact, overloading or other external causes;
- incorrect installation, assembly, disassembly or relocation;
- modification or repair by the consumer or a third party without the prior written consent of SDB Vitrinebouw B.V.
These exclusions apply only insofar as they are not contrary to mandatory consumer law.
Any commercial warranty is additional to the consumer’s statutory rights and does not limit those rights.
Warranty for business customers and resellers
For business customers and resellers, the warranty period and warranty provisions set out in the Metaalunie Terms and Conditions 2025 apply, unless a different warranty has been expressly agreed in writing.
Under Article 13 of the Metaalunie Terms and Conditions 2025, SDB Vitrinebouw B.V. warrants the proper performance of the agreed obligations for a period of six months after delivery, unless otherwise agreed in writing.
If a warranty claim is justified, SDB Vitrinebouw B.V. will decide whether it will:
- repair the defect;
- replace the delivered product in whole or in part;
- credit a reasonable part of the contract price.
The warranty does not apply, among other things, to normal wear and tear, improper use, incorrect maintenance, or installation, modification or repair by the customer or a third party. The business customer must give SDB Vitrinebouw B.V. the opportunity to investigate the defect and provide an appropriate solution.
Submitting a warranty claim
A defect must be reported to SDB Vitrinebouw B.V. in writing as soon as possible after it has been discovered.
The notification should include:
- the order or invoice number;
- the delivery date;
- a clear description of the defect;
- clear photographs of the complete display cabinet and the defect;
- information about the installation, use and circumstances in which the defect arose.
SDB Vitrinebouw B.V. must be given a reasonable opportunity to investigate the defect.
Changes
SDB reserves the right to make minor model and detail changes without prior notice. Minor differences in colour or dimensions may occur. All product descriptions, product information and prices are subject to changes and errors.
